1. Agreement

These Terms of Service ("Terms") govern your use of the Orlando Property Visuals ("OPV") website and services.

Orlando Property Visuals ("OPV") is the operating name of Blue Sky Visuals LLC, a Florida limited liability company providing professional real estate media services throughout Central Florida.

By requesting a quote, booking a service, purchasing media, or using our website, you agree to these Terms.

2. Services

Orlando Property Visuals (OPV) provides professional real estate photography, drone photography, videography, floor plans, virtual staging, social media content, and related real estate marketing services.

Specific deliverables, turnaround times, and pricing will be confirmed at the time of booking.

We reserve the right to decline or cancel any booking when necessary.

3. Booking

A booking is considered confirmed only after written confirmation from Orlando Property Visuals (OPV).

You are responsible for providing:

• Correct property address
• Property access instructions
• Lockbox or gate codes
• Any information necessary to complete the appointment

Incorrect information that prevents completion of the appointment may result in additional fees.

4. Cancellations & Rescheduling

More than 24 hours before the appointment

No cancellation or rescheduling fee.

Less than 24 hours before the appointment

A cancellation or rescheduling fee may apply.

Property not ready or inaccessible

If we arrive and cannot access the property or it is not reasonably ready for photography, a trip fee or rescheduling fee may apply.

Weather

Drone photography may be postponed due to weather or FAA safety restrictions at no additional charge.

5. Payment

OPV first delivers a watermarked preview gallery.

Payment is securely processed through Stripe from the preview. Final unwatermarked files are released after full payment.

Orlando Property Visuals (OPV) does not store your payment card information.

6. Copyright & License

Orlando Property Visuals (OPV) retains the copyright to all photographs, videos, drone imagery, and other media created during a shoot.

After full payment, you receive a non-exclusive license to use the media for marketing the specific property photographed, including:

• MLS
• Social media
• Property websites
• Print marketing
• Personal or brokerage marketing

Media may not be sold, transferred, sublicensed, or used for unrelated commercial purposes without written permission.

7. Portfolio & Marketing Use

Orlando Property Visuals (OPV) retains full copyright ownership of all photographs, videos, drone footage, 3D tours, floor plans, and any other media created during the photoshoot ("Content").

Upon full payment, the Client is granted a limited, non-exclusive, non-transferable license to use the Content solely for the marketing and promotion of the specific property photographed (including MLS, Zillow, Realtor.com, agent websites, social media, and print materials related to that listing).

OPV reserves the right to use the Content for its own promotional and marketing purposes. This includes, but is not limited to:

• Display on the OPV website and portfolio
• Social media posts
• Marketing materials, proposals, and advertisements
• Case studies and promotional content

This promotional use is intended only to showcase the quality of OPV's services and will not be used to advertise the specific property for sale or to imply that OPV is the listing agent or brokerage.

Opt-Out Right

If the Client or the property owner does not want the Content used by OPV for promotional or marketing purposes, they must submit a written request (email is acceptable) either:

1. Before the scheduled photoshoot, or
2. Within 48 hours after the final media is delivered.

OPV will honor reasonable opt-out requests and will not use the Content in public marketing materials going forward.

8. Property Preparation

The property should be clean, staged, and ready before the scheduled appointment.

Our photographers do not perform cleaning, staging, or furniture moving.

If the property is not ready, photography may be completed as-is or rescheduled, subject to applicable fees.

9. Drone Operations

All drone operations are performed in accordance with applicable FAA regulations.

Drone services may be delayed, modified, or canceled due to weather, restricted airspace, or other safety considerations.

10. Limitation of Liability

Orlando Property Visuals (OPV)'s liability is limited to the amount paid for the specific service giving rise to the claim.

We are not responsible for indirect or consequential damages, including lost commissions, delayed listings, or market-related losses.

11. Governing Law

These Terms are governed by the laws of the State of Florida.

Any legal dispute shall be resolved in the courts of Osceola County, Florida, unless otherwise required by law.

12. Changes

We may update these Terms from time to time.

Changes become effective when published on this website.
